Nature of Incident: Fatal Snowmobile Accident
Date / Time: 12-28-08 approximately 5:30 p.m.
Location: Snowmobile Trail #7 Gill Rd. Near US-31, Carp Lake Twp.
Person Involved: Mark A. Foster 48 yo male Rising Son, Ohio resident

According to Sheriff Peter A. Wallin, investigators from the Emmet County Sheriff’s Office are investigating a single snowmobile fatal accident that occurred at approximately 5:30 p.m. in Carp Lake Twp. The accident occurred on trail #7 near Gill Road. The driver of the snowmobile, Mark Foster was pronounced deceased at the scene. Sheriff's Office investigators are continuing their investigation of the fatal accident. The Sheriff’s Office was assisted by Carp Lake Fire Dept., Carp Lake First Responders, Mackinaw City Fire Dept., Mackinaw City Ambulance, Emmet County Medical Examiner and the Emmet County Victim’s Services Unit.

According to Sheriff Pete Wallin, the Emmet County Sheriff's Office is investigating a Breaking and Entering which occurred on Tuesday, December 16, 2008, at approximately 5:00 p.m., at the Harbor Point Association, in West Traverse Township. Deputies were dispatch to a cottage on Harbor Point where a member of Harbor Point Security had witnessed an individual leaving a seasonal cottage on foot carrying an item away from the residence. Harbor Springs Police Department also responded to the scene, and detained the subject until Emmet County Sheriff's Office Deputies arrived. The subject was identified as Matthew Luhellier, 26 yrs old, from Petoskey, MI. Luhellier was arrested without incident and lodged in the Emmet County Jail. Emmet County Prosecutor Jim Linderman has charged Luhellier with Home Invasion-2nd Degree, Breaking and Entering-A Building With Intent, and Larceny in a Building.

On 11-09-08 at approximately 1:30 a.m., Emmet County Sheriff's Deputies responded to the report of a fight in progress at a residence in West Traverse Twp., Emmet County. Jan Van Der Westhulzer, a 27 year old San Francisco resident, was arrested and later charged with eight felony charges.
- Home Invasion First Degree- Felony 20 years and/or $5,000.00
- Assault with Intent To Do Great Bodily Harm Less than Murder- Felony 10 years and/or $5000.00
- Assault with a Dangerous Weapon (Felonious Assault)- Felony 4 years and/or $2,000.00
- 5 Counts of Assaulting / Resisting a Police Officer- Felony 2 years and/or $2,000.00
According to Sheriff Peter A. Wallin, Van Der Westhulzer was a guest at the victim's residence earlier in the evening. According to information obtained during the investigation Van Der Westhulzer is in the United States on a work visa from South Africa. Van Der Westhulzer remains lodged at the Emmet County Jail; bond was set at $100,000.00.
The Emmet County Sheriff's Office was assisted by the Michigan State Police, Harbor Springs Police Department, and Allied EMS at the scene.

Due to weather conditions, the road closure on US 131 between Howard Road and Intertown Road scheduled for October 28, 2008 was cancelled. The road closure has been rescheduled for October 29, 2008. The road closure will begin sometime between 8:30 a.m. and 9:00 a.m. and will be closed for approximately two hours. Traffic will be re-routed around the road closure. The Emmet County Sheriff’s Office has arrested three Emmet County men for assault with intent to do great bodily harm less than murder. Chris Hibbler, Scott Hibbler, and Jacob Hibbler are charged with an October 7th, 2008 assault on a 30 year old Emmet County man. Sheriff Pete Wallin states during a bonfire party the victim was assaulted by the three suspects causing serious injury to the victim.
Sheriff Wallin states the suspects are lodged in the Emmet County jail awaiting arraignment. If you have further information concerning this incident, please contact D/Cpl. J L Sumpter at (231) 439-8901.

Emmet County Sheriff Pete Wallin would like to warn the public of a scam that is in our area. Sheriff Wallin states elderly citizens are receiving calls from who they believe to be their grandson or granddaughter. The suspect poses as their grandchild in trouble or in a situation where they have no money or their credit cards will not work. The suspect asks to have money wired to them in Canada so they can either get out of the country or out of trouble. Sheriff Wallin warns that this is a scam and not to follow the caller’s demands.
Sheriff Wallin also adds it is very common for a suspect to ask to have money wired internationally, mainly through purchases from online auctions. These are scams and you should not wire money to anyone unless you are absolutely sure you are doing it legitimately. If you feel you have received a scam, you are asked to contact D/Cpl. The Emmet County Sheriff’s Office is investigating a two vehicle crash that occurred on 10-06-08 at approximately 5:35 p.m. According to Sheriff Peter A. Wallin the accident happened on M119 at the entrance to the Harbor Park Market. Leon Gschwind, a 75 year old Bloomfield Hills resident, was driving a 2008 Chrysler minivan northbound and made a left hand turn in front of a southbound vehicle. Gschwind had one passenger in his vehicle at the time of the traffic crash. The southbound vehicle was a 2007 Chevy, driven by Fredrick Johnson, a 70 year old Harbor Springs resident. All three subjects were transported to Northern Michigan Hospital by Allied EMS. The Emmet County Sheriff’s Office was assisted Allied EMS, Harbor Springs Fire Dept. and Emmet County Sheriff’s Office Victim Services Unit. The traffic crash remains under investigation.

The Emmet County Sheriff's Office is investigating fatal traffic accident that occurred on Hathaway Road near Kipp Road. According to Sheriff Peter A. Wallin, the crash occurred on 8-21-08 at approximately 7:50 a.m. The crash involved an east bound bicycle that was ridden by Fred Knoodle, a 68 year old Harbor Springs resident. The other vehicle involved was a 1998 Chevrolet truck driven east bound by Stephen Harkleroad, a 40 year old Alanson resident. Fred Knoodle was transported to Northern Michigan Hospital by Allied EMS where he later died. Hathaway Road from North Conway Road to Mink Road was closed for approximately three and a half hours. The crash remains under investigation.

Deputies from the Emmet County Sheriff’s Office were called to a Little Traverse Township home Wednesday August 13th, 2008 reference a home invasion in progress. Sheriff Pete Wallin states deputies were called to the home at approximately 1:20am concerning a husband and wife who broke into the residence and began assaulting the occupants. As the victims were calling 911, the husband and wife team fled the scene toward Harbor Springs.
Sheriff Wallin states a Harbor Springs Police officer stopped the suspects shortly after leaving the victim’s home. The wife assaulted two Michigan State Police troopers and deputies while they were attempting to make the arrests. Both suspects were arrested for Home Invasion and the husband was also arrested for operating while intoxicated. Home invasion in the first degree is a felony punishable for up to life in prison.
Sheriff Wallin would like to thank the Michigan State Police, Harbor Springs Police Department, and Allied EMS for their assistance at the scene.

The Emmet County Sheriff’s Office has seen an increase in day time breaking and entering complaints in the northern portion of Emmet County. Sheriff Pete Wallin states over the past month our department has handled a couple of residential breaking and entering incidents. All incidents occurred while the home is unoccupied and are not easily seen by the roadway or other neighbors.
Sheriff Wallin is asking citizens to please contact his office if they have seen suspicious individuals in their area or if they have had contact with anyone knocking on their door asking for obscure information.
